Terms of Service

By creating a DolphyADS account or using dolphyads.com, you agree to these Terms. If you do not agree, do not use the service.

The service

DolphyADS provides tools to generate ad creative and copy, build and host mini landing pages, and send email and SMS marketing campaigns to contacts you own.

Accounts

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be at least 16 years old and able to form a binding contract.

Acceptable use

You may not use DolphyADS to:

• Send unsolicited messages, purchased lists, or messages to recipients who have not given express consent.
• Promote illegal goods or services, or content in the SHAFT categories (sex, hate, alcohol, firearms, tobacco), cannabis, or high-risk financial offers.
• Impersonate another person or brand, or send deceptive, phishing, or malware content.
• Reverse engineer, resell, or overload the platform.

We may suspend or terminate accounts that violate these rules or that generate excessive spam complaints or carrier violations.

Copyright and ownership agreement

By creating an account you confirm that any content, images, logos, or copy you upload or generate is yours to use and does not infringe anyone's copyright, trademark, or other rights. You also acknowledge that the DolphyADS platform, software, and branding are copyright-protected and may not be copied, resold, or redistributed.

Mobile phone number and SMS consent

Providing a mobile number is optional and only needed if you want SMS alerts. By checking the SMS box at signup, you consent to receive recurring SMS messages from DolphyADS at the mobile number provided. These messages may include account and campaign notifications (such as campaign send confirmations, delivery reports, and new lead alerts), product updates, feature announcements, and promotional offers. Message frequency varies, up to 10 messages per month. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent is not a condition of purchase. Your content

You keep ownership of the content and contact data you upload. You grant us a limited license to host, process, and transmit it solely to operate the service. You warrant that you have the rights and consents needed for everything you send.

Plans, billing, and cancellation

• Paid plans are billed in advance on a recurring basis through Stripe until cancelled.
• You can cancel at any time; access continues until the end of the paid period.
• Fees already paid are non-refundable except where required by law.
• Plan limits (campaigns, generations, sends) are enforced by the platform and may change with notice.

Third-party platforms

Ad networks, email providers, and SMS carriers have their own policies. DolphyADS is not responsible for their decisions, including ad rejections, message filtering, or account suspensions.

Disclaimers and liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, DolphyADS is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

Changes and termination

We may update these Terms; continued use after the update means you accept them. You may stop using the service and delete your account at any time.
